Question no. 25 (Ms. Wilson):

To the Minister of Justice and Attorney General,

(a) will the government adopt the Peckford recommendation to refer all COVID-19 measures and workplace policies to the Court of Appeal by way of the reference procedure to determine if they are contrary to the law and, in particular, our Charter of Rights and Freedoms, and

(b) what legal advice, if any, did the government seek prior to implementing the vaccine passport mandate and the mask mandate?

Answer: March 15, 2022

(a) The government does not intend to direct a reference to the Saskatchewan Court of Appeal respecting our former COVID-19 public health measures. The government is confident that all former Saskatchewan public health measures were compliant with the Canadian Charter of Rights and Freedoms.

(b) The government sought legal advice from officials within the Ministry of Justice and Attorney General about the public health protections respecting proof of vaccination (or negative test) and masking prior to implementation. The precise nature of this legal advice is confidential.
